These Terms of Service ("Terms") are a legal agreement between you and Latentra LLC, a limited liability company ("Latentra", "we", "us"). Latentra operates Fluent Tap, including the web application at fluenttap.app, the Fluent Tap Chrome extension, and, when released, the Fluent Tap mobile and desktop applications (together, the "Service").
By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must create an account to use certain features. You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and be at least 13 years old (or the higher minimum age required in your country).
Fluent Tap helps you look up, save, and practice vocabulary. Using the Service requires an internet connection: word lookups, definitions, and syncing are performed online. Some previously saved content may be available offline with limited functionality. You are responsible for obtaining internet access and for any charges from your network provider.
The free plan includes daily limits, currently 20 word lookups and limited flashcard reviews per day, which reset at midnight local time. Current limits are shown on our pricing page. We may adjust free plan limits over time; if we reduce them, we will communicate the change in the app.
You agree not to abuse the Service, including by: using automated tools, scripts, or scrapers to access the Service or exceed usage limits; reselling or redistributing the Service or its content; attempting to circumvent quotas, security measures, or payment requirements; or interfering with the operation of the Service. We may apply technical rate limits and may suspend accounts engaged in abuse.
Plans. Fluent Tap Pro is offered as a Monthly subscription and an Annual subscription. Current pricing is shown on our pricing page and at checkout.
Merchant of record. Purchases made on our website are processed by Lemon Squeezy, LLC as merchant of record. Your purchase is also subject to Lemon Squeezy's terms. Applicable taxes are calculated and collected at checkout. Purchases made inside our mobile apps, when available, are processed by Apple or Google under their respective terms.
Auto-renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) until cancelled. The renewal price is the price you subscribed at, unless we notify you of a change in advance as described below.
Cancellation. You can cancel at any time from your account or the customer portal linked in your receipt. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then. We do not provide partial refunds for unused time except as described in the Refunds section.
Refunds. Annual subscriptions purchased on our website include a 14-day money-back guarantee: contact support@fluenttap.app within 14 days of purchase for a full refund. Monthly subscriptions can be cancelled at any time but are generally not refunded. For purchases made through Apple or Google, refunds are handled by the respective app store under its policies. Nothing in this section limits any non-waivable statutory refund rights you have under local law.
Price changes. The price you subscribe at is locked for as long as your subscription remains active. If we ever need to change the price of an active subscription, we will notify you at least 30 days in advance, and you may cancel before the change takes effect.
Failed payments. If a renewal payment fails, we may retry the charge and notify you. If payment cannot be collected, your plan reverts to the free tier at the end of the process. Your saved data is not deleted when a subscription ends.
Fluent Tap is a learning aid. Definitions, translations, example sentences, and mnemonics are generated automatically and, despite our safeguards, may occasionally be inaccurate, incomplete, or inappropriate. You are responsible for verifying accuracy where it matters. If you find an incorrect or inappropriate result, please report it to support@fluenttap.app so we can improve.
You retain ownership of the content you create in the Service, including your vocabulary vault, custom edits, and study data ("Your Content"). You grant us a limited license to host, store, process, and display Your Content solely to operate and improve the Service for you.
If we release sharing features (such as shareable flashcard decks) and you choose to share content publicly, you additionally grant us a non-exclusive, worldwide license to display and distribute that shared content to other users as part of the feature, and you confirm you have the rights to share it.
The Service, including its software, design, branding, and original content, is the property of Latentra LLC and its licensors and is protected by applicable intellectual property laws. "Fluent Tap" and our logos may not be used without our prior written consent. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own learning.
The Service depends on third-party providers, including our cloud infrastructure and services, Firebase (authentication and data), Lemon Squeezy (payments), and, for mobile apps, Apple and Google. We are not responsible for third-party services, and your use of them may be subject to their own terms.
You may stop using the Service and delete your account at any time in the app settings. Upon deletion, your personal data is removed as described in our Privacy Policy; this action is irreversible.
We may suspend or terminate your access if you materially breach these Terms, abuse the Service, or if we are required to do so by law. If we terminate your paid subscription without cause, we will refund the unused portion of your current billing period.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that learning outcomes will be achieved.
To the maximum extent permitted by law, Latentra LLC and its directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising from your use of the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or 10 USD if you have not paid us. Nothing in these Terms excludes liability that cannot be excluded under applicable law, and nothing affects your non-waivable statutory rights as a consumer.
We may update these Terms as the Service evolves. We will post the updated Terms with a new "Last updated" date, and for material changes we will notify you in the app or by email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of Mongolia, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Mongolia, except where the law of your country of residence grants you the non-waivable right to bring proceedings in your local courts.
